What is Partner Visa Australia?

Partner Visa Australia Generally you can categorize Partner visa into three and they are:

  • Prospective Marriage Visa (Subclass 300)
  • Partner Visa Onshore/inside Australia (Subclass 820  & 801)
  • Partner Visa Offshore/outside Australia (Subclass 309  & 100) 

Initially you have to apply for a provisional visa which is the first step. Onshore and offshore applicants have to apply for Subclass 820 and Subclass 309 respectively. Prospective Marriage Visa (Subclass 300)

You can call prospective visa as fiance visa as it is for your fiance. Means if you are engaged to An Australian citizen, permanent resident or eligible New Zealand citizen you can look at this visa to enter Australia before marriage. After the wedding you can consider applying for the permanent visa. While applying for this visa, the fiance should be outside Australia.

Partner Visa Onshore (Subclass 820 & Subclass 801)

Partner Visa Onshore and Partner Visa Offshore is depending on the location where your partner is at the time of applying. 

Partner visa onshore is for those whose partner is staying inside Australia at time of applying for the visa. Firstly you have to apply for a Partner Temporary visa (Subclass 820). To be eligible for this visa then your partner should be An Australian citizen or a permanent resident or eligible New Zealand citizen. On approval of this visa then you can stay in Australia with your partner.

After 2 years of provisional visa (Subclass 820), immigration department will assess to see if you are eligible for a permanent partner visa (subclass 801). On obtaining Subclass 801 you can live permanently with your partner in Australia. 

Partner Visa Offshore (Subclass 309 & Subclass 100)

Partner visa offshore is for those whose partner is staying outside Australia at time of applying for the visa. You can apply for this visa to stay with your partner in Australia. Firstly you have to apply for a Partner Temporary visa (Subclass 309). While applying for this visa your partner should be outside Australia. On approval of this visa then you can stay in Australia with your partner.On completion of 2 years of genuine relationship with your partner, you may grant a permanent partner visa (Subclass 100).
